These Terms of Use (“Terms”) govern your access to and use of the Alma Voice Painting experience available at games.alma.inc (the “Service”). The Service is operated by MEMFOLD AI PRIVATE LTD, operating as Alma (“Alma,” “we,” “us,” or “our”).

By accessing or using the Service, signing in, creating a painting, or submitting a painting to the gallery, you agree to these Terms. If you do not agree, please do not use the Service.

1What Alma Voice Painting Does

Alma Voice Painting is an experimental creative experience that allows you to create digital artwork using voice or text instructions.

You can give instructions such as “draw a mountain,” “add a lake,” or “make it sunset,” and the Service will generate or modify a digital painting based on those instructions.

The Service may also allow you to:

• sign in using your Google account;
• save paintings associated with your account;
• display your paintings in a public or shared gallery;
• display your name alongside paintings you choose to save or publish; and
• revisit or interact with paintings you previously created.

The Service and its features may change over time.

2Eligibility

You must be at least 18 years old to create an account, save paintings, or publish content through the Service.

By signing in or using account-based features, you represent that you are at least 18 years old and are legally capable of agreeing to these Terms.

If we reasonably believe that an account belongs to someone who does not meet these requirements, we may restrict or remove the account and associated personal information.

3Google Sign-In

We use Google Sign-In to authenticate users.

When you sign in with Google, we may receive basic account information made available through the authentication process, such as your name, email address, profile image, and a unique account identifier, depending on the permissions requested.

Our collection and use of personal information is described in our Privacy Policy.

Your use of Google services remains subject to Google’s own applicable terms and policies.

You are responsible for maintaining the security of your Google account. Please notify us if you believe someone has gained unauthorized access to your Alma account or saved paintings.

4Voice and Text Inputs

The Service accepts voice and/or text instructions in order to create paintings.

When you use voice input, your speech may be transmitted to and processed by us or our service providers as necessary to interpret your instructions and operate the Service.

Depending on how the Service is configured, we may process audio, transcriptions of your speech, or both. Our Privacy Policy describes what information is collected, how it is processed, whether it is retained, and for how long.

Do not provide sensitive personal information, confidential information, passwords, financial information, or other information that you do not want processed through the Service.

5Your Paintings and Content

You may create paintings, prompts, instructions, titles, descriptions, or other content through the Service (“User Content”).

As between you and Alma, you retain any rights you may have in your User Content, subject to applicable law and any rights belonging to third parties.

You give Alma a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and technically process your User Content for the purposes of:

• providing and operating the Service;
• saving your paintings;
• displaying paintings you submit to the gallery;
• maintaining, securing, and improving the Service; and
• enabling features you request.

This license lasts for as long as your User Content is stored by the Service, except where continued retention is reasonably necessary for legal, security, backup, or compliance purposes.

Public Gallery

If you save, submit, or publish a painting to the public gallery, you authorize us to publicly display:

• the painting;
• the name or display name associated with it; and
• other information that the Service clearly tells you will be public before publication.

Content displayed on the gallery may be visible to anyone.

Do not publish anything that you do not want other people to see.

Where the Service provides an option to remove a painting from the gallery, you may use that option. You may also contact us at vinod@memfold.ai to request removal.

Removing content from the gallery does not necessarily remove copies that other users may already have downloaded, screenshotted, shared, or otherwise independently saved.

6AI-Generated Content

Paintings generated through Alma may be created or modified using artificial intelligence or other automated systems.

Because generated content is produced algorithmically:

• results may be unexpected, inaccurate, offensive, incomplete, or different from what you requested;
• similar or identical content may be generated for different users;
• we do not guarantee that generated content is unique;
• we do not guarantee that you will obtain intellectual property rights in generated content; and
• we do not guarantee that generated content will be free from similarities to existing works.

You are responsible for determining whether and how you use, publish, reproduce, or distribute a generated painting.

7Acceptable Use

You may not use the Service to create, upload, request, publish, or distribute content that:

• violates applicable law;
• infringes another person’s copyright, trademark, privacy, publicity, or other rights;
• impersonates another person in a deceptive or harmful manner;
• contains unlawful threats, harassment, or abuse;
• depicts or facilitates child sexual abuse or exploitation;
• promotes terrorism or other unlawful violent activity;
• contains malicious code or attempts to interfere with the Service;
• attempts to bypass security measures or access another user’s account or data;
• intentionally overwhelms, scrapes, reverse engineers, or abuses the Service; or
• is otherwise unlawful or creates material risk to Alma, our users, or third parties.

We may remove content or restrict access where we reasonably believe it violates these Terms, applicable law, or the safety and integrity of the Service.

8Rights of Others

You should only submit prompts, images, names, likenesses, or other material that you have the right to use.

If you create or publish content involving another person, brand, character, artwork, or other protected material, you are responsible for ensuring that your use is lawful.

If you believe content available through the Service infringes your rights, contact us at vinod@memfold.ai with sufficient information for us to review the request.

9Our Intellectual Property

The Service itself—including Alma’s software, interface, branding, logos, design, technology, and other materials provided by us—is owned by or licensed to Alma and is protected by applicable intellectual property laws.

These Terms do not grant you ownership of the Service or Alma’s intellectual property.

You may not copy, sell, license, reverse engineer, or commercially exploit the Service except where permitted by law or with our written permission.

10Privacy

Your privacy is important to us.

Our Privacy Policy explains:

• what personal information we collect;
• what information we receive through Google Sign-In;
• how voice and text inputs are processed;
• how paintings are stored;
• what information appears publicly;
• which service providers process information on our behalf;
• how long information is retained; and
• how you can exercise applicable privacy rights or request deletion.

By using the Service, you acknowledge that personal information will be handled as described in our Privacy Policy.

11Deleting Your Content or Account

You may request deletion of your saved paintings, account, or associated personal information by contacting us at vinod@memfold.ai.

We may need to retain limited information where required or permitted by law, including for security, fraud prevention, dispute resolution, enforcement of these Terms, or legal compliance.

Deletion from our active systems may not immediately remove information from temporary backups, although such information will remain protected and will be deleted or overwritten according to our retention practices.

12Third-Party Services

The Service may depend on third-party products and infrastructure, including authentication providers, hosting providers, artificial intelligence providers, speech-processing providers, analytics services, and other technical service providers.

We are not responsible for third-party services that you access independently, and those services may be governed by their own terms and privacy policies.

13Experimental Service

Alma Voice Painting may include experimental, beta, preview, or event-specific functionality.

Features may change, stop working, or be removed without notice.

We do not guarantee that:

• the Service will always be available;
• paintings will always be retained;
• generated results will match your instructions;
• saved content will remain available indefinitely; or
• the Service will operate without errors, delays, or interruptions.

If a painting is important to you, you should keep your own copy where the Service allows you to do so.

14Suspension and Termination

We may suspend, restrict, or terminate access to the Service if:

• you violate these Terms;
• your use creates security or legal risk;
• we reasonably suspect fraud or abuse;
• we are required to do so by law; or
• we discontinue the Service.

You may stop using the Service at any time.

Sections that by their nature should survive termination—including intellectual property provisions, disclaimers, limitations of liability, and dispute provisions—will continue to apply.

15Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.”

We make no warranty that the Service will be uninterrupted, secure, error-free, or suitable for any particular purpose.

We do not guarantee the accuracy, originality, legality, quality, or availability of AI-generated paintings or other outputs.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded under applicable law.

16Limitation of Liability

To the maximum extent permitted by applicable law, Alma and its founders, directors, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Service.

This includes, where permitted by law, loss of data, loss of content, loss of profits, business interruption, or damages resulting from reliance on generated content.

Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms limits liability where doing so would be prohibited by law.

17Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless Alma and its affiliates, officers, employees, and contractors from third-party claims, damages, liabilities, and reasonable costs arising from:

• User Content you submit or publish;
• your unlawful use of the Service;
• your infringement of another person’s rights; or
• your material violation of these Terms.

18Changes to the Service or Terms

We may update the Service and these Terms from time to time.

If we make material changes, we may provide notice through the Service or by other reasonable means.

The updated Terms will state their effective or “Last updated” date.

Where applicable law requires your consent to a change, we will request it before applying the relevant change to you.

19Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Subject to applicable law, courts located in Karnataka, Bengaluru, India will have jurisdiction over disputes arising from or relating to these Terms or the Service.

Nothing in this section prevents a user from exercising rights or remedies available under mandatory applicable law.

20General Terms

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a merger, acquisition, corporate reorganization, or transfer of the Service, subject to applicable law.

These Terms, together with our Privacy Policy and any additional terms presented for a particular feature, constitute the agreement between you and Alma concerning the Service.
